Anyone who has ever bought a house or a car, knows what we are talking about.
For these three property owners, there have been No Bona Fide Offers from
anyone. None, not any, not an iota, not one, naught, zip, zero,
zilch.
l As a result, there have been no counter offers.
l Consequently, no discussion of price with anyone.
l Thus, nobody can say what we want for our land.
l Ergo, nobody can say that we want twice that amount.
Therefore, Mayor Shumaker must stop publicly making the case that
they need to take the land because "greedy" owners will not sell it to them.
Why? Because until someone makes us an offer, it is a false
statement.

As you can see from the above property fact sheet, of the three properties
not for sale, only Mr. Rogers has ever been approached by BMS and real estate
agents acting on BMS' behalf. (including Vice Mayor Kelly Graham) The real estate agents
asked....

Mr. Rogers told these fine folks that he had no desire to sale his land
because:
 | It was a great location for his businesses |
 | The creek provided healthy water for his plants (imagine the water bill
without it) |
 | There was plenty of room for his semi trucks and trailers |
 | The trucking company was portable making room for his campground |
 | His nursery business would soon be portable making even more room |
 | He had plans to expand his campground (See
property plans) |
 | The campground business is pretty fun and supplements paying the bills |
 | And he had great neighbors |
Despite having no reason to sell.....He also told them, "However, I will
look at any reasonable offer anyone might want to make."
But there was never any bona fide offer made by anyone!!!!
Mr. Rogers also met once in July 2002 with Jeff Byrd of BMS regarding Rogers' pending lawsuit
against the city for harassment and inverse condemnation when they blocked the
use of Mr. Rogers' driveway that had been in place for 42 years. (The
judge agreed by the way)
During this meeting Mr. Byrd made the following statement to Mr. Rogers:
You know George, we could give you one, two, three, four, or five million,
what ever, to buy your property, but it might be cheaper for us, and better for
you if we leased your land for either one or two weeks during the spring and the
fall. We could come over, do more excavating to bring the mountain down to
2 or 3 levels, pave it and stripe it for car parking, in order to
provide parking for our suite skybox patrons as we do not have enough
parking for them. You then would have use of the land for the rest
of the year.
Mr. Rogers responded, that he did not know if he could operate his nursery
business on pavement because the irrigation water lines run under ground, and
the heat reflecting from pavement might affect plant material, but he would look
at anything that Mr. Byrd would like to purpose.
Mr. Byrd said he would have his engineers look at the feasibility and get
back with Mr. Rogers after the August 2002 race.
To date, he has not gotten back with Mr. Rogers.
Mr. Rogers, not hearing from Mr. Byrd for almost a year,
assumed that they must have solved their parking problem in some other fashion.
Turns out he was mistaken.
Wayne Estes, Vice President of Communications and Events, came
over to visit with Mr. Rogers four weeks before the August 2003 race. He
wanted to lease 300 parking spaces for Suite patrons' parking as they "still"
did not have enough parking. Mr. Rogers told him that for several months his campground had
been booked full with a waiting list for any open spots.
He told Wayne (a super nice guy) that if he had the extra space, he would gladly
lease it to BMS, but he just did not have any vacancy and all the camping
patrons had placed deposits on their camping spots.

In summary:
3 out of 4 land owners, or 75%, do not have their land for sale
2 out of 3 of those land owners, or 66%, have never been approached by anyone
2 out of 4 of the all the owners, or 50%, have never been approached by anyone
Claims that greedy land owners will not sell.....are unfounded!
